I know, as I have recounted elsewhere about my personal situation during my military service, so-called, my military resister time, during the Vietnam War, that the holidays are tough times for our political prisoners, hell all prisoners, but today we write on behalf of our fellow activists behind the walls. A place where we outside the walls may find ourselves under the regime of whatever party in power. (After all Lynne Stewart and Chelsea Manning among others, for example, were in jail in Obama time.) And nobody on the outside working for social change is exempt as the case of the late radical super people’s lawyer, Lynne Stewart, outlined below will demonstrate. So be very generous this year in aid of those on the inside who will garner strength knowing that those outside the walls today are standing in solidarity. I know in my time I did from such support.    

The following article appeared under the Partisan Defense Committee's Class-Struggle Defense Notes masthead in the print version of this issue of Workers Vanguard. The PDC is a class-struggle, non-sectarian legal and social defense organization which champions cases and causes in the interest of the whole of the working people. This year’s Holiday Appeal marks the 32nd year of the Partisan Defense Committee’s program of sending monthly stipends as an expression of solidarity to those imprisoned for standing up to racist capitalist repression and imperialist depredation. This program revived a tradition initiated by the International Labor Defense under James P. Cannon, its founder and first secretary (1925-28). This year’s events will pay tribute to a former stipend recipient, Lynne Stewart, who succumbed to the effects of metastasized breast cancer last March. A courageous radical lawyer who defended numerous poor people and fighters for the oppressed, including the Ohio 7, Stewart had been incarcerated for her vigorous defense of a fundamentalist sheik who was convicted in an alleged plot to blow up New York City landmarks. We honor her by keeping up the fight for the freedom of all class-war prisoners. The PDC currently sends stipends to 12 class-war prisoners.

Mumia Abu-Jamal is a former Black Panther Party spokesman, a well-known supporter of the MOVE organization and an award-winning journalist known as “the voice of the voiceless.” Framed up for the 1981 killing of a Philadelphia police officer, Mumia was sentenced to death explicitly for his political views. Federal and state courts have repeatedly refused to consider evidence proving Mumia’s innocence, including the sworn confession of Arnold Beverly that he, not Mumia, shot and killed the policeman. In 2011 the Philadelphia district attorney’s office dropped its longstanding effort to legally lynch Mumia, condemning him to life in prison with no chance of parole. Last year attorneys for Mumia filed a petition under Pennsylvania’s Post Conviction Relief Act (PCRA) seeking to overturn the denial of his three prior PCRA claims by the Pennsylvania Supreme Court. If successful, he would be granted a new hearing before that court to argue for reversal of his frame-up conviction. On September 7, Judge Leon Tucker ordered a private review of the complete file of the prosecution by the Philadelphia District Attorney’s Office of Mumia’s case, looking for evidence of the personal involvement of then D.A. Ronald Castille, whose refusal as a judge to recuse himself during Mumia’s PA Supreme Court appeal is the basis for this PCRA. After a two-year battle, Mumia was finally able to begin lifesaving treatment for hepatitis C. In May, lab tests showed that he was free of this life-threatening illness. But the drawn-out period during which he was refused treatment left him with an increased risk of liver cancer.
Leonard Peltier is an internationally renowned class-war prisoner. Peltier’s incarceration for his activism in the American Indian Movement has come to symbolize this country’s racist repression of its Native peoples, the survivors of centuries of genocidal oppression. Peltier was framed up for the 1975 deaths of two FBI agents marauding in what had become a war zone on the South Dakota Pine Ridge Reservation. The lead government attorney has admitted, “We can’t prove who shot those agents,” and the courts have repeatedly denied Peltier’s appeals while acknowledging blatant prosecutorial misconduct. Before leaving office, Barack Obama rejected Peltier’s request for clemency. The 73-year-old Peltier is not scheduled for another parole hearing for another seven years. Peltier suffers from multiple serious medical conditions including a heart condition for which he had to undergo triple bypass surgery. He is incarcerated far from his people and family.
Seven MOVE members—Chuck AfricaMichael AfricaDebbie AfricaJanet AfricaJanine AfricaDelbert Africa and Eddie Africa—are in their 40th year of prison. After the 8 August 1978 siege of their Philadelphia home by over 600 heavily armed cops, they were sentenced to 30-100 years, having been falsely convicted of killing a police officer who died in the cops’ own cross fire. In 1985, eleven of their MOVE family members, including five children, were massacred by Philly cops when a bomb was dropped on their living quarters. Collectively known as the MOVE 9, two of their number, Merle Africa and Phil Africa, died in prison under suspicious circumstances. After nearly four decades of unjust incarceration, these innocent prisoners are routinely turned down at parole hearings.
Jaan Laaman and Thomas Manning are the two remaining anti-imperialist activists known as the Ohio 7 still in prison, convicted for their roles in a radical group that took credit for bank “expropriations” and bombings of symbols of U.S. imperialism, such as military and corporate offices, in the late 1970s and ’80s. Before their arrests in 1984 and 1985, the Ohio 7 were targets of massive manhunts. Now Laaman and Manning face prison torture where they are isolated in solitary confinement for extended periods. Manning has been deprived of necessary medical attention. The Ohio 7’s politics were once shared by thousands of radicals but, like the Weathermen before them, the Ohio 7 were spurned by the “respectable” left. From a proletarian standpoint, the actions of these leftist activists against imperialism and racist injustice are not crimes. They should not have served a day in prison.
Ed Poindexter is a former Black Panther supporter and leader of the Omaha, Nebraska, National Committee to Combat Fascism. He and his former co-defendant, Wopashitwe Mondo Eyen we Langa, who died in prison last year, were victims of the FBI’s deadly COINTELPRO operation, under which 38 Black Panther Party members were killed and hundreds more imprisoned on frame-up charges. They were railroaded to prison and sentenced to life for a 1970 explosion that killed a cop, and Poindexter has now spent more than 45 years behind bars. Nebraska courts have repeatedly denied Poindexter a new trial despite the fact that crucial evidence, long suppressed by the FBI, proved that testimony of the state’s key witness was perjured.

Lynne Stewart
1939–2017
Radical attorney Lynne Stewart died in Brooklyn on March 7 at the age of 77. The immediate cause was a series of strokes which, together with metastasized breast cancer, finally drained the life out of this tireless fighter for the oppressed. Lynne’s death will be keenly felt by the incarcerated opponents of the U.S. government, for whom she fought until the end. Without her, the world is a lonelier, crueler place for these prisoners and their families. We offer our condolences to Lynne’s husband, Ralph Poynter, and her entire family.
Born in Brooklyn and raised in Queens, New York, the young Lynne Stewart worked as a librarian in an all-black school in Harlem, developing her political consciousness through direct exposure to and confrontation with the entrenched racism of this society. She went on to law school at Rutgers. A proponent of 1960s New Left radicalism, Lynne dedicated herself to linking struggles of those in the outside world with those behind bars, fighting to keep militant leftists and others reviled by the capitalist state out of the clutches of its prison system.
Paying tribute to the work of Lynne and Ralph, class-war prisoner Mumia Abu-Jamal noted that they fought for decades for such groups as the Black Panthers and the Puerto Rican Young Lords, “but mostly, they fought for the freedom of the poor and dispossessed of New York’s Black and Brown ghettoes.” One of her most prominent cases was the defense of Larry Davis, a young black man in the Bronx who in November 1986 shot his way out of a murderous siege by cops and then became a folk hero for escaping an enormous manhunt for more than two weeks. With Lynne Stewart and William Kunstler arguing Davis’s right to self-defense, in November 1988 he was acquitted of the attempted murder of nine police officers. This stunning legal victory on behalf of victims of racist NYPD terror made Lynne a marked woman in the eyes of the state.
Lynne was also part of the legal team for the Ohio 7, who were prosecuted for their roles in a radical group that took credit for bank “expropriations” and bombings of symbols of U.S. imperialism, such as military and corporate offices, in the late 1970s and ’80s. Having already been sentenced to decades in prison, the Ohio 7 were further prosecuted by the Reagan and Bush Senior administrations under “seditious conspiracy” laws as part of an attempt to criminalize leftist political activity. The government spent over $10 million but failed to win a conviction—a victory for the working class and for all who would oppose the policies of the capitalist rulers. The Ohio 7’s Jaan Laaman recalled: “Lynne truly was fearless and could not be intimidated by prosecutors, judges or FBI and other gun-toting goons.”
With such a bio, Lynne found herself directly in the state’s crosshairs. In February 2005, she was convicted of material support to terrorism and conspiracy to defraud the U.S. government for her vigorous legal defense of Egyptian fundamentalist Sheik Omar Abdel Rahman, who had been convicted for an alleged plot to blow up New York City landmarks in the early 1990s. The purported “material support” was communicating her client’s views to Reuters news service. The “fraud” was running afoul of Special Administrative Measures imposed by the Clinton administration that stripped prisoners of basic rights, including the ability to communicate with the outside world and the Sixth Amendment right to counsel. Her Arabic interpreter Mohamed Yousry and paralegal Ahmed Abdel Sattar were also convicted. As we wrote in “Outrage! Lynne Stewart, Mohamed Yousry, Ahmed Abdel Sattar Convicted” (WV No. 842, 18 February 2005):
“The verdict gives the government a green light to prosecute lawyers for the alleged crimes of their clients, thereby shooting the basic right to counsel to hell.... If nobody can get a lawyer to zealously defend him from prosecution, then fundamental liberties, from the right to a trial and an attorney, to even the right of free speech and assembly, are choked.”
The George W. Bush administration made Lynne Stewart’s prosecution a centerpiece of the bogus “war on terror,” having seized on the September 11 attacks to greatly enhance “anti-terror” measures enacted by Democratic president Bill Clinton. Indeed, she and her codefendants were convicted under Clinton’s 1996 Antiterrorism and Effective Death Penalty Act.
Judge John Koeltl, who praised Lynne for representing “the poor, the disadvantaged and the unpopular,” gave her a 28-month sentence, far less than what the prosecution demanded. Outraged by such “leniency,” the government went to extraordinary lengths to appeal. At the instigation of the Obama administration, a ruling by a three-judge panel of the Second Circuit Court of Appeals directed Koeltl to resentence her to ten years of hard time. On 15 July 2010, Koeltl complied.
We noted at the time that this was intended to be a death sentence for Lynne, who was suffering from Stage IV breast cancer. In prison she was taken to chemotherapy treatments in leg irons and handcuffs shackled to a chain around her waist; the weight of the chains was so heavy that guards had to essentially carry her from her cell to the prison hospital. In December 2010, she was transferred to the federal women’s prison in Carswell, Texas, far from family and supporters. Lynne was being brutally punished for nothing other than standing up to the U.S. government.
It was through the Spartacist League and Partisan Defense Committee’s work in publicizing and rallying to the defense of Lynne Stewart and her codefendants that we came to know and work with her and Ralph, who had differences with our Marxist views. The two of them later became regular honored guests at the PDC’s annual Holiday Appeal benefits for class-war prisoners. Not ones to shy away from a good argument, Lynne and Ralph were quite happy to tweak our noses at the Holiday Appeals and get theirs tweaked in return. With a shared commitment to the fight for solidarity with victims of capitalist state repression, our mutual respect grew as we engaged in political debate.
Lynne’s political principles included not throwing her codefendants under the bus for her own interests. At a Lynne Stewart Defense Committee meeting following her 2005 conviction, PDC supporters stressed the importance of fighting for freedom for her codefendants, Yousry and Abdel Sattar. Lynne applauded this statement. But the defense committee, run by the National Lawyers Guild, abandoned her codefendants.
Longtime “movement” lawyer Liz Fink, who quit the legal team days before Lynne Stewart’s resentencing, filed court papers that despicably tried to exonerate her client by framing up Yousry. Fink accused him of conversing in Arabic with the sheik to further the latter’s aims—a fabrication that the New York Times (7 March) repeated in its obituary for Lynne Stewart. Lynne rose up in court to disavow her attorney and announced that those were Fink’s words, not hers. In fact, Yousry had been writing a PhD thesis on radical Islam in Egypt under the guidance of Near East historian Zachary Lockman, who had advised him to interview the sheik. Yousry’s prosecution left his life in ruins.
In greetings read out by Ralph to a PDC Holiday Appeal in January 2011 in NYC, the imprisoned Lynne denounced the chilling effect of Justice Department witchhunting of political opponents, declaring: “That message once again must be shouted down, first by the resisters who will go to jail and second by us, the movement who must support them by always filling those cold marble courtrooms to show our solidarity and speaking out so that their sacrifice is constantly remembered.” In another letter, she conveyed the deep human solidarity that continued to drive her even under the inhumane conditions of incarceration. She wrote that with the monthly stipend she received as part of the PDC’s support to class-war prisoners, she was able to purchase books and, after finishing them, put them into “circulation” for other inmates. Lynne also used the stipend to help provide other imprisoned women with items like coffee, peanut butter and shampoo.
In 2013, as Lynne’s health precipitously declined, more than 40,000 people signed petitions demanding her release. At the request of her attorney, a medical doctor associated with the PDC meticulously documented how Lynne met all criteria for hospice eligibility by the government’s own guidelines. This played a role in procuring her release later that year when the Justice Department, after months of obstruction, finally allowed Koeltl to free her on the grounds of her “terminal medical condition and very limited life expectancy.” Arriving at LaGuardia airport on New Year’s Day 2014, Lynne, who could barely walk, told her supporters, “I’m going to work for women’s group prisoners and for political prisoners.” Being back with her family and back in the struggle literally added years to her life.
In honoring Lynne Stewart, we recognize a hard, effective champion of the oppressed. We salute her lifework, which is an inspiration to those fighting for social justice against the rulers of this racist capitalist society.

No Question Impeachment Is Not Enough, Not Nearly Enough For What One Donald J Trump Has Done But Where The Hell Do You Go With It

Back in the early 1970s when we had a comparable problem with a POSTUS, then one Richard Milhous Nixon, petty thief and major criminal I remember reading a headline from some left-wing newspaper which heralded in big bold type “Impeachment Is Not Enough.” And it was not, could not be for all the violations of bourgeois political norms as loose as they were then to speak nothing of his role in keeping troops in Vietnam long past their due date. The political configurations were a bit different then, including that it had been a century since a sitting president was to head to the dunking stool. The gest of that headline was that Nixon should face an international tribunal composed of his war victims, or their representations (the dockets would have been overflowing in that case for he would not be alone in that housecleaning). That real justice never happened since the felon avoided the perp walk complete with orange jumpsuit by resigning before the gauntlet fell.

Now we have a situation which clearly admits to an impeachment proceeding for violations of bourgeois norms and conscious obstruction of justice staring with the boss, with the POSTUS, now one Donald J. Trump, petty thief and major criminal all the way down the slippery slope to who knows what end. But the configuration is all wrong this time although if there was a way to get a conviction in the Republican-dominated Senate  I would move mountains to see that small piece of justice done. But the times have no such look. A Democratic major in the House responding to their base, or their sense of what is right in American political discourse, has though myriad committees decided to draft and eventually vote on some articles of impeachment. That task done the ball is in the Senate’s court which I have already mentioned is stacked the other way. Once again the bad guys will draw a pass from a little social justice.   

What I worry about and you should too is the fallout from the failure to convict. Stacked or not this would be a tremendous propaganda victory for Trump and his minions. The only virtue is that perhaps it is far enough away from next November’s elections so that the factor is blunted, although it will not go away. The Democrats, including their current crop of presidential candidates ready to smite Mr. Trump, have generally supported the impeachment process. But they, despite some candidates’ significant poll edges over Trump NOW, will bear the burden of the hellfire and mud coming down on this one. You did not hear this bad tiding news here first but you have heard it here.

Those of us of a certain generation, let’s call it like Frank Jackman, another writer in this stable likes to call us, the “Generation of ’68,” reflecting the turmoil and turbulence of our youth, and, no, not 1868 will occasionally have what I will euphemistically call a lapse but which is more generally named a senior moment. Such an event occurred recently to my good friend known since the high school battle days in the 1960s hence also a ‘68er, Sam Lowell.
Sam, a Vietnam veteran whose experience turned him against war after what he saw, and did, in Vietnam, has one way or another been involved with some combination of veterans  to try to bring the message of peace to a sometimes deaf or indifferent world. For the past several years he had been an ardent member of a national veterans group, Veterans for Peace, if you live in big cities, or near them you might have seen their fluttering black dove emblem on white background flags in some peace parade. The organization, like most organizations, has periodic business meeting to discuss what has happened in the past period and what plans should be laid going forward.
Fair enough. However at the last monthly meeting the Recording Secretary was absent (an excused absence since he was ill) and the chairperson requested somebody to fill in and do the minutes. Since virtually nobody except a person with a great memory would want the job on a long term basis, or short, everybody in the meeting room quickly put their guilty heads down. Unfortunately Sam didn’t get his down fast enough and he was dragooned, his word, by the crafty chair since his head was up. So he did the notes as direction which he intended to clean up the next day and ask for any corrections, etc. on the group’s website. No problem there either as he got some helpful corrections and then put out a final set of minutes on the website.     
Alright that sets the stage. Now, according to Sam, one of the nice parts of the meeting agenda is near the beginning in what are called “opening words, where somebody volunteers to say a few words, read a passage, recite a poem to put things in perspective. So a fellow member, noting the gathering war clouds over issues like North Korea and Iran by the administration in Washington, thoughtfully presented Mark Twain’s The War Prayer from 1904. A very powerful and thought-provoking little piece of work. Initially Sam, realizing that the website would have many more people on it than generally attend meetings attached the piece to the end of the minutes. And that is where the senior moment comes in.
Let Sam take it from here as he sent out a separate e-mail based on his “error”:
“Here is the basis of my senior moment and see if you agree. Yesterday December 15th I sent out the minutes from Monday’s General Meeting (which I was dragooned into producing but that did not have anything to do with the senior moment). At the end, the very end of those minutes I placed a copy of Mark Twain’s The War Prayer (1904) which our brother Dan Henry had present during the Opening Words section of the meeting.
“The senior moment? Well who the hell, including me, reads the freaking minutes much less go the bottom of the endless thing to find a gem of a poem. To rectify things I have placed Mr. Twain’s excellent take on the war clouds looming in his day here where hopefully it will be read. Thanks Dan Henry for your presentation. It was a time of great and exalting excitement. The country was up in arms, the war was on, in every breast burned the holy fire of patriotism; the drums were beating, the bands playing, the toy pistols popping, the bunched firecrackers hissing and sputtering; on every hand and far down the receding and fading spreads of roofs and balconies a fluttering wilderness of flags flashed in the sun; daily the young volunteers marched down the wide avenue gay and fine in their new uniforms, the proud fathers and mothers and sisters and sweethearts cheering them with voices choked with happy emotion as they swung by; nightly the packed mass meetings listened, panting, to patriot oratory which stirred the deepest deeps of their hearts and which they interrupted at briefest intervals with cyclones of applause, the tears running down their cheeks the while; in the churches the pastors preached devotion to flag and country and invoked the God of Battles, beseeching His aid in our good cause in outpouring of fervid eloquence which moved every listener.
It was indeed a glad and gracious time, and the half dozen rash spirits that ventured to disapprove of the war and cast a doubt upon its righteousness straightway got such a stern and angry warning that for their personal safety's sake they quickly shrank out of sight and offended no more in that way.
Sunday morning came – next day the battalions would leave for the front; the church was filled; the volunteers were there, their faces alight with material dreams-visions of a stern advance, the gathering momentum, the rushing charge, the flashing sabers, the flight of the foe, the tumult, the enveloping smoke, the fierce pursuit, the surrender! – then home from the war, bronzed heros, welcomed, adored, submerged in golden seas of glory! With the volunteers sat their dear ones, proud, happy, and envied by the neighbors and friends who had no sons and brothers to send forth to the field of honor, there to win for the flag or, failing, die the noblest of noble deaths. The service proceeded; a war chapter from the Old Testament was read; the first prayer was said; it was followed by an organ burst that shook the building, and with one impulse the house rose, with glowing eyes and beating hearts, and poured out that tremendous invocation – "God the all-terrible! Thou who ordainest, Thunder thy clarion and lightning thy sword!"
Then came the "long" prayer. None could remember the like of it for passionate pleading and moving and beautiful language. The burden of its supplication was that an ever – merciful and benignant Father of us all would watch over our noble young soldiers and aid, comfort, and encourage them in their patriotic work; bless them, shield them in His mighty hand, make them strong and confident, invincible in the bloody onset; help them to crush the foe, grant to them and to their flag and country imperishable honor and glory.
An aged stranger entered and moved with slow and noiseless step up the main aisle, his eyes fixed upon the minister, his long body clothed in a robe that reached to his feet, his head bare, his white hair descending in a frothy cataract to his shoulders, his seamy face unnaturally pale, pale even to ghastliness. With all eyes following him and wondering, he made his silent way; without pausing, he ascended to the preacher's side and stood there, waiting.
With shut lids the preacher, unconscious of his presence, continued his moving prayer, and at last finished it with the words, uttered in fervent appeal,"Bless our arms, grant us the victory, O Lord our God, Father and Protector of our land and flag!"
The stranger touched his arm, motioned him to step aside – which the startled minister did – and took his place. During some moments he surveyed the spellbound audience with solemn eyes in which burned an uncanny light; then in a deep voice he said
"I come from the Throne – bearing a message from Almighty God!" The words smote the house with a shock; if the stranger perceived it he gave no attention. "He has heard the prayer of His servant your shepherd and grant it if such shall be your desire after I, His messenger, shall have explained to you its import – that is to say, its full import. For it is like unto many of the prayers of men, in that it asks for more than he who utters it is aware of – except he pause and think.
"God's servant and yours has prayed his prayer. Has he paused and taken thought? Is it one prayer? No, it is two – one uttered, the other not. Both have reached the ear of His Who hearth all supplications, the spoken and the unspoken. Ponder this – keep it in mind. If you beseech a blessing upon yourself, beware! lest without intent you invoke a curse upon a neighbor at the same time. If you pray for the blessing of rain upon your crop which needs it, by that act you are possibly praying for a curse upon some neighbor's crop which may not need rain and can be injured by it.
"You have heard your servant's prayer – the uttered part of it. I am commissioned by God to put into words the other part of it – that part which the pastor, and also you in your hearts, fervently prayed silently. And ignorantly and unthinkingly? You know it took a long time for me to figure out why I was drawn, seemingly out of nowhere, to the mountain music most famously brought to public, Northern public, attention by the likes of the Carter Family, Jimmy Rodgers, The Seegers and the Lomaxes. As a kid I could not abide it but later on I figured that was because I was so embroiled in the uprising jail-break music of my generation, rock and roll, that anything else faded, faded badly by comparison. Later in high and school after when I hung around Harvard Square I would let something like Gold Watch and Chain register a bit, registering a bit then meaning that I would find myself occasionally idly humming such a tune. But again more urban, more protest-oriented folk music by the likes of Bob Dylan, Joan Baez, Dave Von Ronk,  Tom Paxton, Phil Ochs was what caught my attention more when the folk minute was at high tide in the early 1960s.           

Then one day not all that many years ago as part of a final reconciliation with my family, going back to my own roots, making peace with my old growing up neighborhood, I started asking many questions about how things turned so sour back when I was young. More importantly asking questions that had stirred in my mind for a long time and formed part of the reason that I went for reconciliation. To find out what my roots were while somebody was around to explain the days before I could rightly remember the early day. And in that process I finally, finally figured out why the Carter Family and others began to “speak” to me.         


The thing was simplicity itself. See my father hailed from Kentucky, Hazard, Kentucky long noted in song and legend as hard coal country. When World War II came along he left to join the Marines to get the hell out of there. During his tour of duty he was stationed for a short while at the Portsmouth Naval Base and during that stay attended a USO dance held in Portland where he met my mother. Needless to say he stayed in the North, for better or worse, working the mills in Olde Saco until they closed or headed south for cheaper labor and then worked at whatever jobs he could find. All during my childhood though along with that popular music that got many mothers and fathers through the war mountain music, although I would not have called it that then filtered in the background on the family living room record player. But here is the real “discovery,” a discovery that could only be disclosed by my parents. Early on in their marriage they had tried to go back to Hazard to see if they could make a go of it there. This was after my older brother Prescott was born and while my mother was carrying me. Apparently they stayed for several months before they left to go back to Olde Saco before I was born since I was born in Portland General Hospital. So see that damn mountain was in my DNA, was just harking to me when I got the bug. Funny, isn’t it.

Every hobo, tramp, and bum and there are social distinctions between each cohort recognized among themselves if not quite so definitely by rump sociologists who lump them all together but that is a story for another day has seen starlight on the rails. Has found him or herself (mainly hims though out on the “jungle” roads) flat up against some railroad siding at midnight having exhausted every civilized way to spent the night. Has seen the stars out where the spots are darkest and the brilliance of the sparkle makes one think of heaven for those so inclined, think of the void for the heathen among them. Has dreamed dreams of shelter against life’s storms.

But not everybody has the ability to sing to those heavens (or void) about the hard night of starlight on the rails and that is where the late Rosalie Sorrels, a woman of the American West out in the Idahos, out where, as is said in the introduction to the song, the states are square (and at one time the people, travelling west people and so inured to hardship, played it square, or else), sings old crusty Utah Phillips’ song to those hobo, tramp, bum heavens. Did it while old Utah was alive to teach the song (and the story behind the song) to her and later after he passed on in a singular tribute album to his life’s work as singer/songwriter/story-teller/ troubadour.         


Now, for a fact, I do not know if Rosalie in her time, her early struggling time when she was trying to make a living singing and telling Western childhood stories had ever along with her brood of kids been reduced by circumstances up against that endless steel highway but I do know that she had her share of hard times. Know that through her friendship with Utah she wound up bus-ridden to Saratoga Springs in the un-squared state of New York where she performed and got taken under the wing of Lena from the legendary Café Lena during some trying times. And so she flourished, flourished as well as any folk-singer could once the folk minute burst it bubble and places like Café Lena, Club Passim (formerly Club 47), a few places in the Village in New York City and Frisco town became safe havens to flower and grow some songs, grow songs from the American folk songbooks and from her own expansive political commentator songbook. And some covers too as her rendition of Starlight on the Rails attests to as she worked her way across the continent. Worked her way to a big night at Saunders Theater at Harvard too when she called the road quits a decade or so ago (2002 actually). So listen up, okay.

“Jesus, they charged me fourteen dollars each for these tickets to see Pete Seeger and Arlo Guthrie. Remember Laura about ten or fifteen years ago when we saw Pete for five bucks each at the Café Nana over in Harvard Square (and the price of an expresso coffee for two people and maybe a shared piece of carrot cake since they had been on a date, a cheap date when he didn’t have much cash and at a time when the guy was expected to pay, no “dutch treat,” no Laura dutch treat expected anyway especially on a heavy date, and that one had been when he was intrigued by her early on) and around that same time, that same Spring of 1973, Arlo gave a free concert out on Concord Common,” said Sam Lowell to his date Laura Peters and the couple they were standing in line with, Patrick Darling and Julia James, in front of Symphony Hall in Boston waiting for the doors to open for the concert that evening. This would be the first time Pete and Arlo had appeared together since Newport a number of years back and the first time this first two pairs had seen either of them in a good number of years since Pete had gone to upstate New York and had been spending more time making the rivers and forests up there green again than performing and Arlo was nursing something out in Stockbridge. “Maybe, Alice,” Patrick said and everybody laughed at that inside joke. 

Sam continued along that line of his about “the back in the days” for a while, with the three who were also something of folk aficionados well after the heyday of that music in what Sam called the “1960s folk minute” nodding their heads in agreement saying “things sure were cheaper then and people, folkies for sure, did their gigs for the love of it as much as for the money, maybe more so. Did it, what did Dave Van Ronk call it then, oh yeah, for the “basket,” for from hunger walking around money to keep the wolves from the doors. For a room to play out whatever saga drove them to places like the Village, Harvard Square, North Beach and their itch to make a niche in the booming folk world where everything seemed possible and if you had any kind of voice to the left of Dylan’s and Van Ronk’s, could play three chords on a guitar (or a la Pete work a banjo, a mando, or some other stringed instrument), and write of love, sorrow, some dastardly death deed, or on some pressing issue of the day.”

After being silent for a moment Sam got a smile on his face and said “On that three chord playing thing I remember Geoff Muldaur from the Kweskin Jug Band, a guy who knew the American folk songbook as well as anybody then, worked at learning it too, as did Kweskin, learned even that Harry Smith anthology stuff which meant you had to be serious, saying that if you could play three chords you were sure to draw a crowd, a girl crowd around you, if you knew four or five that  meant you were a serious folkie and you could even get a date from among that crowd, and if you knew ten or twelve you could have whatever you wanted. I don’t know if that is true since I never got beyond the three chord thing but no question that was a way to attract women, especially at parties.” Laura, never one to leave something unsaid when Sam left her an opening said in reply “I didn’t even have to play three chords on a guitar, couldn’t then and I can’t now, although as Sam knows I play a mean kazoo, but all I had to do was start singing some Joan Baez or Judie Collins cover and with my long black hair ironing board straight like Joan’s I had all the boy come around and I will leave it to your imaginations about the whatever I wanted part.” They all laughed although Sam’s face reddened a bit at the thought of her crowded with guys although he had not known her back then but only later in the early 1970s.                     

Those reference got Julia thinking back the early 1960s when she and Sam went “dutch treat” to see Dave Van Ronk at the Club Blue. (Sam and Julia were thus by definition not on a heavy date, neither had been intrigued by the other but folk music was their bond and despite persistent Julia BU dorm roommate rumors what with Sam hanging around all the time had never been lovers). She mentioned that to Sam as they waited to see if he remembered and while he thought he remembered he was not sure. He asked Julie, “Was that the night he played that haunting version of Fair and Tender Ladies with Eric Von Schmidt backing him up on the banjo?” Julie had replied yes and that she too had never forgotten that song and how the house which usually had a certain amount of chatter going on even when someone was performing had been dead silent once he started singing.
Club Blue had been located in that same Harvard Square that Sam had mentioned earlier and along with the Café Nana, which was something of a hot spot once Dylan, Baez, Tom Rush and the members of the Kweskin band started hanging out there, and about five or six other coffeehouses all within a few blocks of each other (one down on Arrow Street was down in the sub-basement and Sam swore that Dylan must have written Subterranean Homesick Blues there). Coffeehouses then where you could, for a dollar or two, see Bob, Joan, Eric (Von Schmidt), Tom (Rush), Phil (Ochs) and lots of lean and hungry performers working for that “basket” Sam had mentioned earlier passed among the patrons and be glad, at least according to Van Ronk when she had asked him about the “take” during one intermission, to get twenty bucks for your efforts that night.

That was the night during that same intermission Dave also told her that while the folk breeze was driving things his way just then and people were hungry to hear anything that was not what he called “bubble gum” music like you heard on AM radio that had not been the case when he started out in the Village in the 1950s when he worked “sweeping out” clubs for a couple of dollars. That sweeping out was not with a broom, no way, Dave had said with that sardonic wit of his that such work was beneath the “dignity” of a professional musician but the way folk singers were used to empty the house between shows. In the “beat”1950s with Kerouac, Cassady, Ginsberg, and their comrades (Dave’s word reflecting his left-wing attachments) making everybody crazy for poetry, big be-bop poetry backed up by big be-bop jazz the coffeehouses played to that clientele and on weekends or in the summer people would be waiting in fairly long lines to get in. So what Dave (and Happy Traum and a couple of other singers that she could not remember) did was after the readings were done and people were still lingering over their expressos he would get up on the makeshift stage and begin singing some old sea chanty or some slavery day freedom song in that raspy, gravelly voice of his which would sent the customers out the door. And if they didn’t go then he was out the door. Tough times, tough times indeed.             
Coffeehouses too where for the price of a cup of coffee, maybe a pastry, shared, you could wallow in the fluff of the folk minute that swept America, maybe the world, and hear the music that was the leading edge then toward that new breeze that everybody that Julie and Sam knew was bound to come what with all the things going on in the world. Black civil rights, mainly down in the police state South, nuclear disarmament, the Pill to open up sexual possibilities previously too dangerous or forbidden, and music too, not just the folk music that she had been addicted to but something coming from England paying tribute to old-time blues with a rock upbeat that was now a standard part of the folk scene ever since they “discovered” blues guys like Mississippi John Hurt, Son House, Bukka White, and Skip James. All the mix to turn the world upside down. All of which as well was grist to the mill for the budding folk troubadours to write songs about.

Julie made her companions laugh as they stood there starting to get a little impatient since the doors to the concert hall were supposed to open at seven and here it was almost seven fifteen (Sam had fumed, as he always did when he had to wait for anything, a relic of his Army days during the Vietnam War when everything had been “hurry up and wait”). She had mentioned that back then, back in those college days when guys like Sam did not have a lot of money, if worse came to worse and you had no money like happened one time with a guy, a budding folkie poet, Jack Dawson, she had a date with you could always go to the Hayes-Bickford in the Square (the other H-Bs in other locations around Boston were strictly “no-go” places where people actually just went to eat the steamed to death food and drink the weak-kneed coffee). As long as you were not rowdy like the whiskey drunks rambling on and on asking for cigarettes and getting testy if you did not have one for the simple reason that you did not smoke (almost everybody did then including Sam although usually not with her and definitely not in the dorm), winos who smelled like piss and vomit and not having bathed in a while, panhandlers (looking you dead in the eye defying you to not give them something, money or a cigarette but something) and hoboes (the quiet ones of that crowd  who somebody had told her were royalty in the misfit, outcast world and thus would not ask for dough or smokes) who drifted through there you could watch the scene for free. On any given night, maybe around midnight, on weekends later when the bars closed later you could hear some next best thing guy in full flannel shirt, denim jeans, maybe some kind of vest for protection against the cold but with a hungry look on his face or a gal with the de riguer long-ironed hair, some peasant blouse belying her leafy suburban roots, some boots or sandals depending on the weathers singing low some tune they wrote or reciting to their own vocal beat some poem. As Julie finished her thought some guy who looked like an usher in some foreign castle opened the concert hall doors and the four aficionados scampered in to find their seats.                 

…As they walked down the step of Symphony Hall having watched Pete work his banjo magic, work the string of his own Woody-inspired songs like Golden Thread and of covers from the big sky American songbook and Arlo wowed with his City of New Orleans and some of his father’s stuff (no Alice’s Restaurant that night he was saving that for Thanksgiving he said) Sam told his companions, “that fourteen dollars each for tickets was a steal for such performances, especially in that acoustically fantastic hall” and told his three friends that he would stand for coffees at the Blue Parrot over in Harvard Square if they liked. “And maybe share some pastry too.”

They say that Allan Jackson, a guy who grew up in North Adamsville south of Boston and a guy who as the neighborhood guys he used to hang out with used to say was “from hunger”  which seems self-explanatory, was kind of weird about stuff like politics and art. Stuff that seemed weird to me anyway when it got explained to me by my father, same name as me and hence junior, one night when he decided that I needed one, a drink or two, and, two, to be straightened out about Allan. Straightened out meaning that he would do his royal highness imperative thing with me which he has done with me since I was a kid when he thought I had something, sometimes anything wrong.       

Dad’s authority for the straightening out was that he was one of the guys who knew Allan in those “from hunger” days back in the 1960s when the whole neighborhood, including the Fox family, was wedded to that same condition. He felt since he had already straightened me out ad infinitum on the Fox family “from hunger” story when I was about eight he could skip that and run Allan’s story. I have to tell you though that Bradley Fox, Senior pulled himself up from under by the bootstraps and went on to run a couple of small high tech specialty plants which were contracted to Raytheon to make materials for their various very lucrative defense contracts and while he sold off those businesses when he retired Raytheon is still working off the public teat with those lucrative, very lucrative defense contracts. I also have to tell you that except for a couple of months out in San Francisco in 1967 when the Summer of Love for his generation was in full bloom at a time when his whole crowd was guilt-tripped into going out West by a mad man guy they hung around with whom Dad always called Scribe he went straight-arrow from high school to college (two years), marriage, kids, a decent and “not from hunger” life passed on to his kids and then that fairly recent retirement.

That combination strong work ethic and straight arrow family man would characterize most of his hang-out youthful crowd with the big exception of Scribe. And Allan who followed him for a while anyway before Scribe got too weird, got catch up with a cocaine addiction and fell down, was helped falling down by two straight bullets in Mexico back in the 1970 in circumstances Dad would not talk about, won’t talk about even now since he says it hurts him too much to think about Scribe’s fate, a fate that except for a few happy turns might have befallen him. So the “Allan following Scribe” part consisted of essentially two things-a visceral hatred of current day capitalism partially derived through an old-fashioned now somewhat obsolete except for academics Marxism, you know, greedy capitalist (my father to a certain extent although he was not, is not,  greedy) versus downtrodden workers AND a love of painting from the early days of capitalism-when it was beginning to come full bloom in places like London, Amsterdam and Antwerp-painters like Rembrandt, Hals, Ruebens.    

Dad said it was hard to say when Scribe and therefore Allan got into radical politics since no way in high school when they all formed lasting bonds did those guys have such ideas. They would have been run out of town, would emphatically not have been hanging around Harry’s Variety Store with Dad and the other guys spouting “commie” rag stuff in those Cold War beat the Russians to a pulp days. What they all cared about, what they all talked about was cars, not having cars the fate of most of them during high school, girls, and either not having them of how to get into their pants, Dad’s expression not mine, booze, and how to get somebody old enough to “buy” for them, and endlessly rock and roll music, and how to use that hot rock and roll to get a girl into a car, get her softened up with booze and in the mood to do what he called “do the do” which I think is pretty self-explanatory as well. So maybe girls was all they really cared about in the end and the other stuff was just talk to talk. One way or another Scribe and his ardent follower, his “girl” some of the guys would say just to do a little “fag” baiting long before even guys like Dad got hip that being gay was okay, that they were not the devils incarnate, were as hyped to the chasing girls scene as all the others. 

Dad figured that what probably happened to turn them around was their getting drafted and sent to Vietnam (neither events at the same time but close together) and when they returned they were very different in ways Dad couldn’t explain but different mainly because neither man wanted to talk about the stuff they saw, did, or saw others do in what they would always call “Nam. So they started hanging around with college guys and gals, maybe others too, all young and bright-eyed over in Cambridge the other side of Boston. Started going to things called study groups and such. The long and short of it was before long they were longed-haired, bearded hippie-looking guys just like a million other guys around Boston at the time Dad said. Getting arrested for this and that, stuff called civil disobedience not robberies or mayhem or anything like it. Kept talking about class struggle, kicking the bosses’ asses, decaying capitalism, imperialism all the stuff you read about in a Government class and then let drop like a lead balloon after an exam. That lasted like I said until Scribe fell down and Allan went back to school on the G.I. Bill.    

The craving for Dutch and Flemish painting Dad said was easier to explain, at least he thought so. It seemed like this Allan was a holy goof, a wacko to me in our old neighborhood terms out in the leafy suburbs. Dad said, and this is the way Allan explained it to him so take it for what its worth since you know I think it is the uttering of a holy goof. According to this Marxist schematic even though now capitalism (now now or fifty years ago now it doesn’t matter since it is still around) has turned in on itself, has lost its energy, has become a brake on serious human progress that was not always the case. In the early days when it was giving feudalism the boot it was what they called “progressive,” meaning it was better than feudalism and so did things then that could be supported in historical terms by latter day radicals. Okay, Allan, whatever you say.

Here’s where I think it really gets weird, art, all the cultural expressions, get reflected in the emerging new system of organizing society so when Rembrandt say painted those prosperous dour-looking merchants, town burghers, and shop owners (and their wives, also dour, see above. usually in separate portraits showing that had enough real money to pay for two expensive paintings or else couldn’t stand being in the same room together for the long sittings) he was reflecting the bright light times of this new system that would wind up dominating the world. According to Dad Allan and another guy went, I think he said, to the Museum of Fine Arts in Boston Allan where he flipped out over these odd-ball portrait or domestic scene paintings in the 16th and 17th century Dutch-Flemish section. Said, and Dad quoted this, that was when capitalism was young and fresh and you could feel it in almost every painting. Also said while the stuff wouldn’t pass art muster today it was like catnip back then. Like I said a holy goof. And if you don’t believe me go, if you are near a major museum which would have such art, and check it out for yourself because young or old, Rembrandt or not, this stuff is old hat as far as I am concerned.

I don’t usually like to get into the mighty thicket of controversy in the art world not having paid all that much attention to trends over the past several years or more since Sam Lowell and then amateur (her designation) Laura Perkins took over the major assignments in that area. Except now I have been challenged on my defense of one Ellsworth Kelly who passed away a few years ago at an old age after have imbibed various art trends most notably color, the color school that formed at least in part to a reaction against the dominance of abstract expressionism and its going off the deep end.  

Here is how this played out since it is hardly a current controversy or even for that matter an ancient one at this point. A friend of mine and I were walking in the Museum of Modern Art in San Francisco when we came upon a series of Ellsworth Kelly paintings, the usual interesting combination of colors and shapes that gave me a gathered collective effect after sitting and observing for a few minutes. That friend asked me point blank whether I liked the configuration or liked any particular piece. I said I liked most of it although I was far from being a color aficionado now, or then when it was serious trend. She responded that the work left her cold, left her somewhat disturbed by the hubris and hinted at the question of questions always hidden in the depths of the art world coterie whether this was really art when you came down to it.    

The match was on. Let’s start off with the true proposition that art is the highest expression of humankind’s capacity to wonder, and to act on that impulse to create some piece of simple beauty in a stark world. The question then becomes taking on the process of decision made throughout history by pros, by the people paying the freight for the productions or by the artist him or herself to create something beyond the mundane to determine what is what in any particular time-or fashion. That is when a million schools contend although more so since the post Renaissance period where fashion and taste have tended to move much faster in the world. Unlike said the period immediately before, medieval times when, the narrow contests were between those who created (and adored) say the Blessed Mother Mary, complete with baby Jesus on lap and putti asunder and the grizzly scenes around the various tortures of Jesus, the Christ before the nailed him to some tree.        

It is that edge, that sense of need to produce something different, to take art in a different direction that has been the most common and explosive development of the last few centuries. And hence to Ellsworth Kelly (and others like the latter Rothko) who having seen high style Impressionism give way to war-torn Surrealism and Dadaism then Abstract Expressionism take the art world by a storm after the latter carnage of World War II reacted in the one of two possible ways-back to some form of representational art which has sustained the profession forever or shift gears and move away from the hodge-podge of abstraction to a more stylized sense of color (and form always together in my book). [In a recent introduction to this new series, a series based on short film reviews for films that deserve short reviews if not just a thumb’s up or down I noted that Allan Jackson, the deposed previous site manager, required his film reviewers to write endlessly about the film giving the material an almost cinema studies academic journal take on it. That caused a serious decline in the number of reviews over the years which I hope to make up with a flurry of snap reviews for busy people. Hold it I am not going to talk about red state Texas, nor about rising star in some quarters of Beto O’Rourke, nor even about the oil-rich Texas of the 1950s Giant which made James Dean’s short career resume blossom and solidified Rock Hudson as a matinee idol (his subsequent tragic fate, his coming out of the closet with his AIDS announcement does not take away from that 1950s status). No, today we are going back to post-Civil War Texas (which was rebel gray) and the big-time cattle drives that drove that state’s economy well before the oil came gushing out of the ground in the film Texas. We will look at the fortunes of a couple of defeated “Johnny Rebs” trying to make their young ways in the world after their lost cause had been defeated.

The story line hinges on the exploits of Todd, played by Glenn Ford last seen in this space trying to make time with B-movie queen Gloria Grahame very married to a bad ass guy whom she hates but will not give her up and Dan, played by William Holden last seen in this space face down in Norma Desmond’s swimming pool in the high numbers end of Sunset Boulevard in the film of the same name. No, that is not right on the Holden sighting, last seen snapping his provocative jazz beat fingers at provocative come hither Kim Novac in Picnic. They leave the war-weary South to try their luck in Wild West, wide open lawless, or rather make your own law with a gun Texas. Which at the start get them into a series of semi-comic escapades around a stage robbery and end with them on opposites sides in the cattle wars-Todd as the “good guy” herd driver to an insatiable market and Dan as the “bad guy” rustler.

Naturally something has to give, despite their comradeship, and in the end Dan had to go down, had to take the bullet from guys who wanted the whole cattle business to themselves leaving not only “Rustlin’ Dan” out of the picture but Todd as well. RIP Dan, RIP. Oh, wait a minute did I mention, silly me, the love angle. Dan and Todd both were smitten by the same woman, the oddly named “Mike,” hard-headed and independent daughter of a rancher. You know in the end only one guy can be left standing-and there was only one. Dan might have rued his exit, might have asked for a better ending that a few spare bullets to his body but that was the way it was in Wild West Texas. Short enough, Greg?
